February 14,2020 <br /> Murco Properties,Inc. <br /> 2200 Old Highway No.8 <br /> New Brighton,MN 55112 <br /> Attn:Mark Murlowski <br /> Site: 2200 Old Highway NO.8 <br /> New Brighton,MN 55112 <br /> Applicant: Sathre-Bergquist,Inc. <br /> 150 Broadway Ave.S. <br /> Wayzata,MN 55391 <br /> Attn:David Pemberton <br /> Murlowski Properties,Inc.and Murco,Inc.(Owners)are the owners of the subject properties of this application. <br /> To begin,the Owners are requesting a Site Plan Amendment for an application previously submitted for a preliminary plat and final plat. <br /> Currently there are no plans to develop the property. The main purpose of this project at this time is to clean up problematic property <br /> descriptions and any title issues. There a several legal descriptions which have ambiguities and omissions that were creating overlaps <br /> within the property and overlaps with adjoining parcels. Over the last year the Murlowski's,their attorneys and our surveying department <br /> have been working with the title company and neighbors trying to resolve the overlap issues on the neighboring parcels. The internal <br /> overlaps will be cleaned up through the platting process. The title company and the Ramsey County Surveyor have been consulted,have <br /> review the proposed legal description,and have agreed this is the best way to clean this up. <br /> Second,the Site Plan Amendment we are requesting is presenting a 2-lot plus an Outlot preliminary and final plat verses the original 2 lot <br /> preliminary plat and final plat. Lot 1 encompasses an existing building owned by Murco Inc.and some additional land in order to increase <br /> the size of that parcel through the platting process. Lot 2 is multiple remnant parcels creating a large lot with a clean property description <br /> for potential future platting and development. Outlot A is a 60-foot-wide parcel providing access to Lot 1,Lot 2,and Old Highway No.8. <br /> Outlot A is designed to encompass part of future access road as shown on the preliminary plat. Also note, 30-foot-wide ROW running <br /> along the north property line remains. This ROW has served as a private drive for Owner's property along with other properties for <br /> decades and will remain as is. <br /> Third,this Site Plan Amendment proposes to amend previously approved Resolution 15-038. A condition of this Resolution is to preserve <br /> in a natural state an adequate buffer between Old Highway 8 and Owner pile and equipment storage area. Owner requests this condition be <br /> eliminated allowing the proposed south corridor roadway within proposed Outlot A. The excessive distance and limiting pile height now <br /> preclude the need for a buffer. <br /> Final,city Resolution 2019-068 SUP authorizing Owner to relocate allowed rubble piles. This Resolution stands;except,item 4 page 3 of <br /> 7 mis-states Owner's intention. It is Owner's understanding that costs associated with the design and construction of the newly routed <br /> Rush Lake drainage is the city's responsibility. Owner's offer to provide a reasonable amount of land as an easement to install and <br /> maintain the yet to be designed storm water pipe. Along these lines,the existing Rush Lake drainage pipe running to the north and west on <br /> Owner's property will be abandoned. Based on a current title search there does not appear to be a recorded easement document covering <br /> the existing Rush Lake drainage pipe. Owners request that if any recorded or unrecorded easement should be discovered that the city will <br /> vacate or abandon said easements upon construction of a newly routed Rush Lake drainage pipe. <br /> Please contact me with any questions. <br /> David B.Pemberton,Licensed Land Surveyor <br />
