December 11, 2018 Page 8 of 10 <br />property. <br />Councilmember Dunsworth feared how Mr. Burrs would be able to conform with the City’s requirements <br />given the number of cars that were coming to and from this property on a daily basis. She expressed concern <br />that there has been a pattern of non-conformance in the past and that this business may continue to be a code <br />enforcement issue for the City. <br />Councilmember Burg stated the Council wants businesses in the community the City can trust. She requested <br />further information from staff on how code enforcement issues were managed by staff. Assistant <br />Community Assets and Development Director Gozola discussed the process that was followed by staff for <br />code enforcement issues. He anticipated the process would take two to four weeks to complete. City <br />Attorney Sonsalla advised the City would have to notify the property owner and business owner regarding <br />this matter if the Council wanted to revoke the SUP. <br />Mayor Johnson commented on the additional cost the City would have to incur in order to keep this property <br />in conformance with City Code. She questioned if another condition should be added to require quarterly <br />inspections of the property for the next three years to ensure Mr. Burrs was remaining in compliance with the <br />terms of his SUP. She stated if this were considered and supported by the Council, she could offer her <br />support for the SUP. <br />Mr. Burrs asked if his employees could park their cars on the Bona Brothers property. Mayor Johnson stated <br />this was a concern to her as vehicles should not be spilling out from Mr. Burrs’ business onto adjacent <br />properties. She explained Mr. Burrs had 22 parking spots and that was it. Assistant Community Assets and <br />Development Director Gozola recommended the 22 parking spaces on the site be re-striped in order to assist <br />staff with bring this property into conformance. He provided further comment on the staff recommended <br />conditions. <br />Mayor Johnson expressed concern with the fact that Mr. Burrs had mislead Councilmember Burg. Mr. Burrs <br />stated he chose to not comment on Councilmember Burg’s question. <br />Councilmember Burg disagreed with this statement and noted the cars parked at Bona Brothers were Mr. <br />Burrs after she checked in with Bona Brothers. <br />City Manager Lotter asked if Mr. Burrs had read all of the conditions as recommended by staff and if he <br />would be able to comply with these conditions. Mr. Burrs stated he had read all of the conditions and would <br />remain compliant. He asked if the striping could be completed in the spring when the weather would be more <br />conducive. Community Assets and Development Director Schlichting stated it would be difficult for Mr. <br />Burrs to strip his parking lot in the winter. He reported the parking lot could be marked for the winter via <br />other methods and noted paint could be used in the spring. <br />Larry Barenbaum, 4035 West 65th Street in Edina, stated he was surprised by some of the conversation the <br />Council was having. He discussed his work history and encouraged the Council to consider the fact that Mr. <br />Burrs was young and needed to be mentored. He noted he would be a part of Mr. Burrs business and <br />explained he would assist in guiding him in an honorable manner. <br />Councilmember Allen questioned what type of potential hazards were on the site, such as the propane tank. <br />Mr. Burrs reported he has seen the owner of the property access the propane tank so he had the understanding <br />this was not a hazard. <br />Councilmember Jacobsen stated he would have to see active code enforcement on this property in order to <br />offer his support. He asked that any violation in the future be forwarded directly to the City Council for <br />review and consideration. <br />Councilmember Burg indicated she was very uncomfortable considering this matter given Mr. Burrs history <br />with the City and the fact that he was not truthful. She understood Mr. Burrs had leased the space for auto <br />repairs, but recommended no car sales or customers be allowed on this property. <br />Councilmember Dunsworth asked how the Maplewood property would be utilized. Mr. Burrs explained this <br />would be his largest property and would be used for indoor and outdoor retail auto sales. He indicated he <br />would have space to park 50 cars on this property. <br />Councilmember Dunsworth questioned why Mr. Burrs was requesting to have auto sales at the 383 Old <br />Highway 8 property.
