AGREEMENT <br /> <br />I. PARTIES <br /> <br />This agreement is made and entered into by and between the City of New Brighton, <br />MN and (“City”) and Community Partners with Youth (“CPY”). <br /> <br />II. RECITALS <br /> <br />A. CPY is a non-profit organization, which supports families by providing <br />supervision and direction for youth through after-school, holiday and summer <br />enrichment programs in New Brighton and the surrounding area. <br /> <br />B. Through this Agreement, the City intends to contract with CPY to provide <br />such services to its residents and to act as a sponsor of CPY by providing <br />financial support, a method to establish appropriate services to be provided. <br /> <br />C. This Agreement shall be used as the form agreement between CPY and the <br />City. This Agreement is intended to continue the spirit of cooperation and <br />collaboration in the provision of youth enrichment services between the City <br />and CPY. <br /> <br /> <br />III. TERMS AND CONDITIONS <br /> <br />In consideration of the mutual understandings of this Agreement, the parties hereby agree <br />as follows: <br /> <br />A. Prior Agreement Cancelled. By execution of this Agreement any prior <br />agreements and amendments thereto between the parties are hereby cancelled. <br /> <br />B. Services Provided. CPY shall provide the City and its residents with summer <br />time, after school, and out of school youth programs. <br /> <br />C. Principles of Service and Program Establishment and Operations. On a yearly <br />basis and prior to submission of its annual budget, as provided for hereafter, <br />CPY shall report regarding proposed changes in services and programs to the <br />City. <br /> <br />D. Funding <br /> <br />1. In addition to the participating municipality’s share of the annual <br />budget, funds for the operation of CPY will be raised by CPY <br />endeavoring to secure user fees, grants and appropriations from private <br />organizations, the State of Minnesota, Federal and County agencies, <br />and other legally appropriate sources.
