<br />RESOLUTION No. <br />06-012 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING AL06-001 <br /> <br />WHEREAS, an application has been made by Bradley Void to be considered <br />for a Minor Subdivision application for properties 309 11th Avenue NW, <br />1020 3rd Street NW and 1000 3rd Street NW; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Minor Subdivision was filed with the City of New <br />Brighton on January 5, 2006. <br /> <br />2. On January 24, 2006 the City Council reviewed AL06-001. <br /> <br />WHEREAS, the City Council makes the following Findings of Fact In <br />respect to AL06-00 1: <br /> <br />I.The subject site is zoned R-I, Single Family Residential with a minimwn <br />lot area requirement of 10,000 s.f. <br />2.The proposed use is allowed in the R-1 zoning district. <br />3. The future use for the site is general business; and the proposed use is <br />consistent with New Brighton Comprehensive Plan. <br />4.The applicant is requesting a Minor Subdivision application. <br />5.A Minor Subdivision application is required for the City to permit the <br />applicant to split of the eastern 126' of this property and for it to then be <br />added to the adjoining properties at 1020 3rd Street NW and 1000 3rd Street <br />NW. <br /> <br />6.As specified in Section 26-18 (2) of the New Brighton City Code, Minor <br />Subdivisions may be granted when "the newly created property line will not <br />cause the other remaining portion of the lot to be in violation with this <br />Chapter or the Zoning Code". <br />7.The applicant has proposed conforming lots after the subdivision of the <br />eastern 126'. <br /> <br />8.As specified in Section 26-18 (2) "the division may be approved by the <br />City Council after submission of a survey by a registered land surveyor <br />showing the original lot and the proposed division". <br />9.The applicant has submitted a survey depicting original and proposed lot <br />dimensions and original and proposed legal descriptions. <br />
