<br />II <br /> <br />RESOLUTION No. <br />06-013 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING MS06-001 & <br />MS06~003 <br /> <br /> <br />HEREAS, an application has been made by the City of New Brighton to be <br />sidered for a Minor Subdivision application for property located on the west <br />of Old Highway 8 NW within the Northwest Quadrant; and <br /> <br />HEREAS, the procedural history of the application is as follows: <br /> <br />An application for a Minor Subdivision was filed with the City of New <br />B ghton in January of 2006. <br />On January 24,2006 the City Council reviewed MS06-001 & MS06-003. <br /> <br />HEREAS, the City Council makes the following Findings of Fact in respect to <br />06-001 & MS006-003: <br /> <br />The subject site is zoned MX, Mixed Use. <br />The proposed use is allowed in the MX zoning district. <br />The future use for the site is general business; and the proposed use is <br />c sistent with New Brighton Comprehensive Plan. <br />The applicant is requesting a Minor Subdivision application. <br />A Minor Subdivision application is required for the City to allow portions of <br />Northwest Quadrant to proceed. <br />As specified in Section 26-18 (2) of the New Brighton City Code, Minor <br />S bdivisions may be granted when ..the newly created property line will not cause <br />other remaining portion of the lot to be in violation with this Chapter or the <br />ning Code". <br />As specified in Section 26-18 (2) "the division may be approved by the City <br />uncil after submission of a survey by a registered land surveyor showing the <br />o ginallot and the proposed division". <br />Surveys and existing and proposed legal descriptions have been completed. <br /> <br />
