<br />RESOLUTION No. <br />06-014 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING MS06-002 <br /> <br />WHEREAS, an application has been made by the City of New Brighton to be <br />considered for a Minor Subdivision application for property located at the <br />SW comer of 16th Street NW and Silver Lake Road; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Minor Subdivision was tiled with the City of New <br />Brighton in January, 2006. <br />2. On January 24, 2006 the City Council reviewed MS06-002. <br /> <br />WHEREAS, the City Council makes the following Findings of Fact in respect <br />to MS06-002: <br /> <br />1.The subject site is zoned R-l, Single Family Residential with a minimum <br />lot area requirement of 10,000 s.f. <br />2.The proposed use is allowed in the R-l zoning district. <br />3.The future use for the site is general business; and the proposed use is <br />consistent with New Brighton Comprehensive Plan. <br />4.The applicant is requesting a Minor Subdivision application involving <br />property ID#19-30-23-24-0001. <br />5.A Minor Subdivision application is required so that the appropriate right- <br />of-way can be dedicated and conveyed to Ramsey County, described as the <br />east 5' of Lots 1,2 and 7, Block 10, Oakwood Manor Terrace Plat 3. <br />6.As specified in Section 26-18 (2) of the New Brighton City Code, Minor <br />Subdivisions may be granted when "the newly created property line will not <br />cause the other remaining portion of the lot to be in violation with this <br />Chapter or the Zoning Code". <br />7.As specified in Section 26-18 (2) "the division may be approved by the <br />City Council after submission of a survey by a registered land surveyor <br />showing the original lot and the proposed division". <br />8.The necessary legal description has been submitted. <br /> <br />ill <br />
