The properties involved in this parking easement issue are:
441-445 Old Highway 8—Everest Properties LLC
C/O John Higgins (612) 702-3104 john@guidedcre.com
750 4th St NW, 2 parcels—JAMATAR II LLC
755 4th St NW—JAMATAR II LLC
C/O Paul Archambault (612) 408-5399 paul@stinsonelectricinc.com
All three of the properties were built and occupied by the Murlowski family and Belair Builders Inc in the
1960s and 70s. In 1992-93 the Murlowskis divided the parcels and sold them to three separate owners.
In 1997 a series of disputes about parking and ingress/egress culminated in a settlement that created
several easements and provided Everest Properties a parking easement on property now owned and
maintained by JAMATAR II.
Historically the parcel has not been used for Everest parking due to the distance from their building and
lack of visibility from their parking lot. Everest tenants and guests have used other parking spaces within
the ROW for 4th St NW, on unmarked spaces on "Parcel A"to the south of the striped parking area and
in the access easement.
With these historical facts in mind we propose the following changes to parking on our properties.
1. Create new parking spaces contiguous to the Everest Property to foster improved traffic flow
and improve safety and convenience for Everest tenants and visitors. Exhibit B-spaces 1-10
2. Provide permanent easements for the new parking areas
3. Vacate the parking easement on the south east corner of"Parcel B"—Exhibit A—dark blue
4. Vacate the ingress/egress easement immediately north of"Parcel B"—Exhibit B—light blue
5. Reconfigure the fence and gate at Parcel B to make a secure parking area for construction
vehicles and equipment— Exhibit A- pink
6. Preserve the ingress/egress easement north of the 755 Building—Exhibit B—light blue
7. Create four additional diagonal parking spaces on the east side of the 755 building Exhibit B
8. Vacate the city ownership of 4th St NW from Old Highway 8 to the connection with Parcel A This
street extension has been maintained cooperatively by the adjacent property owners for 10+
years including paving, seal coating and snowplowing. Exhibit B—green
9. Improve stormwater and snow melt drainage for the 750 and 441-445 properties by adding
catch basin(s) and connecting to the storm sewer that transverses the property.
