REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: Consider Approval of Special Permission for corner lot setbacks at 1176 Long <br />Lake Road based on visual compatibility with surrounding properties <br />DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of Community Assets and Development <br />CITY MANAGER’S APPROVAL: <br />No comments to supplement this report ___ Comments attached ___ <br />15.99 Deadline: none <br />Recommendations: Approval of a resolution granting special permission for corner lot <br />setbacks in accordance with Section 4-040(3)(A) of the City’s Zoning <br />Ordinance. <br />Legislative History: Request for special permission received on 4/29/19 <br />Financial Impact: None <br />Summary: Ian Craig, resident at 1176 Long Lake Road, is seeking to construct an addition <br />on top of an existing garage which sits on the corner of Long Lake Road and <br />Pike Lake Circle. The new addition would go straight up and would not <br />expand the footprint of the existing structure which appears to be legally <br />nonconforming to setbacks from both streets. Typically staff would require a <br />variance be sought for a project like this, but two unique sections of code <br />(ostensibly written for cases just like this) provide an accelerated process for <br />approval. <br />First, Section 4-040(3)(A) states that R-1 properties improved prior to August <br />21, 1981 (this home was built in 1959 and subsequently improved in the 70’s) <br />are not to be considered nonconforming to the side street setback. <br />Furthermore, when adjacent properties are already improved (which they <br />are), Council may grant “special permission” to change the setback <br />requirements on corner lots like this one based on the “visual compatibility <br />with surrounding properties.” <br />Report Number: 7 <br />Agenda Section: Consent (VII) <br />Report Date: May 6, 2019 <br /> Council Meeting Date: May 14, 2019
