1 <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />FOR 821 7TH AVENUE NW TO AUTHORIZE CONSTRUCTION OF AN ACCESSORY <br />BUILDING IN EXCESS OF 624 SQUARE FEET <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the laws of <br />the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan and <br />corresponding zoning regulations to promote orderly development and utilization of land within the city; and, <br /> <br />WHEREAS, Ron and Jackie Finney (the “Applicants”) made application to the City on 4/3/2019 for a special <br />use permit to authorize construction of an accessory structure (garage) in excess of 624 square feet for the <br />property at 821 7th Avenue NW which is legally describe as: <br />Lot 11, Block 1, Redmond Addition, Ramsey County, Minnesota. <br />and <br /> <br />WHEREAS, the existing garage being replaced is currently legal nonconforming to required setbacks and the <br />new garage will be conforming to codes in every way; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission on May 21st 2019; and <br />WHEREAS, the Planning Commission held a public hearing on the request at the May 21st meeting and <br />considered input from residents; and <br />WHEREAS, the Planning Commission recommended approval of the request based on the applicant’s <br />submittals and findings of fact; and <br />WHEREAS, the City Council considered on May 28th, the recommendations of the Planning Commission, <br />staff, the Applicant's submissions, the contents of the staff report, and other evidence available to the Council. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton hereby <br />approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for residential use by the comprehensive plan, and a <br />detached garage in excess of 624 square feet can be permitted via a special use permit in <br />the corresponding R-1A zoning district. <br />2. Construction of the proposed garage will not be detrimental to or endanger the public <br />health, safety, morals, comfort, or general welfare.
