<br />" <br /> <br />~ <br /> <br />RESOLUTION N094-138 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A DRAINAGE EASEMENT IN THE <br />HALVA'S FIRST ADDITION PLAT (LOCATED ON FAIRFIELD DRIVE). <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. Robert Halva, property owner, requested the vacation of the drainage easements. <br />2. The City Council held a public hearing on December 13, 1994, and the written <br />comments and analysis of City Staff were considered. <br /> <br />Now, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON makes the <br />following Findings of Fact in respect to the proposed vacation: <br /> <br />1. Tract "C" Registered Land Survey No.3 and other adjoining property has been platted <br />as Halva's First Addition. The drainage easement created by Document No. 556250 <br />covers a portion of Lot 3 and Lot 4, Block 1, Halva's First Addition, Ramsey County, <br />Minnesota. <br />2. The platting and development of Halva's First Addition created new easements on LO,ts <br />3 and 4 for drainage and stormwater ponding and resulted in the construction of new <br />storm sewer to protect against flooding. <br />3. The old drainage easement created by Document No. 556250 over the South 250 feet <br />of Tract "C" Registered Land Survey No.3, Ramsey County, Minnesota is no longer <br />needed. <br />4. Vacating the s.ubject easement would serve to avoid confusion on the land title and <br />would not alter the lots or easements created by the Halva's First Addition plat. <br />5. This vacation does not affect any easements shown on Halva's First Addition plat, <br />approved July 28, 1992. <br /> <br />BE IT FURTHER RESOLVED, a drainage easement was obtained through condemnation proceedings <br />by the City's predecessor, the Village of New Brighton, dated March 26, 1971, and filed with the <br />Registrar of Titles of Ramsey County, Minnesota as Document No. 556250 over the following <br />described property: <br /> <br />The South 250 feet of Tract "C" Registered Land Survey No.3, Ramsey County, <br />Minnesota. <br /> <br />BE IT FURTHER RESOLVED, the requested drainage easement vacation is hereby approved. <br /> <br />Adopted this 13th day of December, 1994. <br /> <br />ATTEST: <br /> <br />~~J <br /> <br />~ <br />Margaret g , <br />Finance Director/City Clerk <br /> <br /> <br />ATTEST: <br /> <br />(SEAL) <br />
