<br /> <br />REQUEST FOR COUNCIL CONSIDERATION <br /> <br />ITEM DESCRIPTION: Consider Letter to Senators Amy Klobuchar and Senator Tina Smith to Maintain <br />Local Authority over Wireless Facilities Placed in the Right of Way. <br />DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of DCAD <br />CITY MANAGER’S APPROVAL: <br />No comments to supplement this report ___ Comments attached ___ <br /> <br />Recommendation: <br />Authorize Mayor to sign letters to Senators Klobuchar and Smith regarding use of Right of Way. <br /> <br />Legislative History: <br />8/22/2017 City Council Approved Ordinance No. 853 and a Resolution Amending Chapter 32 (Public <br />Right‐of‐Way) of the New Brighton City Code to include Right‐of‐Way Amendments for Small Wireless <br />Facilities and allowing for a summary publication. <br /> <br />Financial Impact: <br />NA <br /> <br />Explanation: <br />A bill that would limit local authority over the use of public rights of way for small cell wireless <br />facilities was recently reintroduced in the U.S. Senate. <br /> <br />The bill (S. 1699), known as the Streamlining The Rapid Evolution And Modernization of Leading‐edge <br />Infrastructure Necessary to Enhance Small Cell Deployment Act (or STREAMLINE Small Cell <br />Deployment Act), is authored by U.S. Sens. John Thune (R‐SD) and Brian Schatz (D‐HI). It would update <br />the Communications Act to codify many parts of the FCC’s Small Cell order into federal law. <br /> <br />The bill would complicate current efforts by cities to comply with the FCC Order and Minnesota <br />Statute, as well as negotiations with industry partners to ensure a balanced approach to wireless <br />siting. <br /> <br />Further, it would put into federal law parts of the FCC Order that greatly limit local authority over <br />small cell wireless deployments in public rights of way, including provisions in the order that are <br />currently being challenged in court by a myriad of state and local government organizations. The bill <br />would also impose a “deemed granted” provision where applications for wireless siting would <br />automatically be approved if a city missed the application review deadlines. <br />Agenda Section: Consent <br />Report Date: 7.2.19 <br />Council Meeting Date: 7.9.19
