Nuisance Declared. <br />Each violation of the provisions of this Article is declared to be a nuisance affecting the <br />public peace, safety, and general welfare. <br />Sec. 17-53. Complaints. <br />The Public Safety Department shall investigate all complaints. If after investigation there <br />appears to be a violation of this Article, the Investigating Officer shall be authorized to sign <br />a complaint. <br />17-52. Impounding of vehicles. <br />The city may take into custody and impound any abandoned, unlicensed, or junk vehicles <br />that are being stored or parked in violation of this section. <br />17-53. Notice and appeal option. <br />Before taking into custody and impounding an abandoned, unlicensed, or junk vehicle, the <br />Code Compliance Officer must give ten (10) calendar days mailed written notice to the <br />owner of or person in control of the property on which the vehicle is located. The notice <br />must include: <br />(1) A description of the vehicle; <br />(2) Notification that the vehicle must be removed or properly stored within ten days of the <br />date of the notice; <br />(3) Notification that if the vehicle is not removed or properly stored as ordered, the vehicle <br />will be towed and impounded at an identified location; <br />(4) An explanation that the vehicle may be reclaimed within fifteen (15) days of being <br />towed and upon payment of all towing and storage charges and in accordance with the <br />procedures contained in Minnesota Statues Section 168B.07, or it will be disposed of in <br />accordance with Minnesota Statutes Section 168B.08; and <br />(5) A notice that prior to the date that the vehicle is to be towed by the city, the owner of <br />the vehicle or the owner of or person in control of the property on which the vehicle is <br />located may appeal the order, in writing, to the City Council. <br />(A) No further action on the towing and impoundment of the vehicle may be taken <br />until the City Council concludes its review of the appeal; <br />(B) The City Council shall act on a timely written request at its next regularly <br />scheduled meeting or subsequent meeting.
