Consider a Resolution Denying a Fifteen Foot Side Yard Setback Variance <br />requested by Capital Partners Management and WilsonWolf. <br /> <br />Motion by Councilmember Dunsworth, seconded by Councilmember Allen to approve a Resolution <br />denying a fifteen foot side yard setback variance requested by Capital Partners Management and <br />Wilson Wolf. <br /> <br />City Manager Massopust indicated Assistant Director of Community Assets and Development Gozola would <br />be presenting this item to the Council. <br />Assistant Director of Community Assets and Development Gozola stated Wilson Wolf is a tenant of the <br />Industrial building at 2100 Old Highway 8 which was constructed up against the property’s <br />northern side yard setback to maximize useable area on the south side of the lot. A service door <br />on the north side of the building provides access to the Wilson Wolf cafeteria and break room, <br />and they would like to improve that amenity by adding an outdoor patio with a pergola and <br />permanent BBQ station adjacent to the door. The patio would take up the entirety of the <br />setback, and would be approximately 19 feet from the surface of the future roadway planned to <br />serve the Murlowski property to the north. Staff commented further on the request and reported <br />the Planning Commission recommended denial of the request, but recommended the Council <br />direct staff to create an Interim Use Permit tool which could be used in circumstances like this. <br />Councilmember Jacobsen explained Wilson Wolf would prefer to keep the patio on the side of <br />the building versus the front. He noted if the patio were located on the front of the building, <br />this would invade the privacy of the executive offices on the front of the building. <br />Councilmember Dunsworth asked if other cities have an Interim Use Permit tool. Assistant <br />Director of Community Assets and Development Gozola stated this was a common tool in other cities. <br />Councilmember Dunsworth commented she believed it would be smart for the City to pursue the Interim Use <br />Permit tool. <br />Councilmember Allen explained he met with a representative from Wilson Wolf. He stated he supported the <br />Interim Use Permit compromise. He requested further information on how the Interim Use Permit language <br />would be drafted. Assistant Director of Community Assets and Development Gozola described how staff <br />would draft an Interim Use Permit portion of City Code for the City of New Brighton. He commented on the <br />approval process that would have to be followed for the Interim Use Permit code amendment. <br /> <br />A roll call vote was taken. 5 Ayes, 0 Nays-Motion Carried <br /> <br />Relief Association. <br /> <br />8.
