Agreement and the proposed Settlement. <br />VI. NOTICE TO CLASS MEMBERS <br />A. Upon entry of the Preliminary Approval Order, the Settlement Administrator <br />will provide notice to each Class Member as provided by the Class Notice Program in this <br />Section VI. <br />B. As soon as practicable upon entry of the Preliminary Approval Order, the <br />Settlement Administrator will send a Class Notice to each Class Member by U.S. mail to the <br />last -known address for each Class Member based on information provided by Defendants <br />and Class Counsel regarding the persons understood to be renting apartment units at Pike <br />Lake Apartments on December 10, 2019.' <br />C. The Settlement Administrator will direct to Class Members the best notice <br />practicable under the circumstances, including direct mail notices in substantially similar form <br />and substance to the Class Notices attached hereto as Exhibit A and some form of <br />publication notice, which will be detailed in the Motion for Preliminary Approval. <br />D. If a Class Notice is returned to the Settlement Administrator as <br />undeliverable, the Settlement Administrator will make a reasonable effort to find a current <br />address for the Class Member whose Class Notice was returned (i.e., to "skip trace") using <br />one or more information databases accessible to the Settlement Administrator, and will re - <br />send the Class Notice to such address. The Settlement Administrator will not be required to <br />re -send any Class Notice that is returned a second time as undeliverable. <br />E. The Settlement Administrator will certify to Class Counsel and Defense <br />Counsel in writing the date or dates on which Class Notice was mailed to the Class <br />z For avoidance of doubt, April Brown, Eric Williams, and the Class Representatives are each <br />Class Members entitled to receive Class Notice. <br />15 <br />
