7

Mr. Murlowski reported he did not want the City Council to take action on this item and but
rather would like to withdraw the request versus being required to provide the City with the 30 -
foot easement. Assistant Director of Community Assets and Development Gozola commented the
applicant could withdraw the request prior to the Council taking action on the item. He
recommended the Planning Commission make a recommendation at this time and that staff
meet with the applicant later this week to discuss the matter further prior to being reviewed by
the City Council.
Commissioner Biedenfeld stated he was sympathetic to the property owner but noted he
understood the recommendation being made by staff.
Mayor Johnson commented by requiring this easement the future development rights of the
property owner of Lot 2 were being protected.
Mr. Murlowski indicated the proposed easement would not do any party any good. He explained
access to Old Highway 8 would not ever be granted. He explained the only thing that the
easement would do would be to place a hardship on Murlowski and Lot 1 by making the building
and truck scale non-conforming.
Motion by Commissioner McQuillan, seconded by Commissioner Frischman, to reaffirm the
recommendation made to the City Council regarding the Preliminary and Final Plat for the
property at 2200 Old Highway 8.
Approved 4-2 (Biedenfeld and Melquist opposed).

2) ZONING CODE UPDATE PROJECT: Annotated Outline Review.

Assistant Director of Community Assets and Development Gozola reviewed the annotated outline
that had been drafted for the Zoning Code update project. The revised project timeline was
reviewed and it was recommended a temporary steering committee of nine to eleven people be
formed to discuss the zoning code updates. He rep orted the City secured a $25,000 grant to
assist with covering the expenses of the visioning process being planned for Silver Lake Road. The
project goals were discussed in detail with the Commission.
Chair Nichols-Matkaiti questioned if AirBNB’s should be considered in the Zoning Code. Assistant
Director of Community Assets and Development Gozola stated this matter was reviewed by the
Council last year and the Council wanted property rights to be maintained and no action was
taken to amend City Code.
Chair Nichols-Matkaiti asked how the steering committee will be formed. Assistant Director of
Community Assets and Development Gozola reported the City Council would determine how the
steering committee would be formed.
