<br /> <br />3 <br /> <br />There were no comments from the public. <br />Motion by Commissioner McQuillan, seconded by Commissioner Biedenfeld to close the Public <br />Hearing. <br />A roll call vote was taken. Approved 6-0. <br />Motion by Commissioner Biedenfeld, seconded by Commissioner McQuillan, to recommend the <br />City Council approve Ordinance 874, an Ordinance establishing temporary use regulations for the <br />City of New Brighton. <br />A roll call vote was taken. Approved 6-0. <br />VII. Business Items <br />(A) Midtown Village Phase III Final Plat/PRD – Dominium Senior Building. <br />Assistant Director of Community Assets and Development Gozola reported Dominium is seeking <br />approval of a Final Planned Residential Development for Phase III of the Midtown Village <br />development. This final phase will include preparation of the remaining land north of Old Highway <br />8 for development, installation of public improvements, and construction of the affordable senior <br />housing building (to be called Oaks Landing). Preliminary approval for this development was <br />granted by the City Council on May 28th, 2019. Staff provided further comment on the request and <br />recommended approval of the , based on the findings of fact and subject to the following <br />conditions: <br />1. Engineering comments in the 5/15/20 Engineering Memo shall all be addressed moving <br />forward, and the City reserves the right to hold up filing of the final plat and/or permits until <br />applicable conditions are satisfied. <br />2. The applicant shall enter into a developer’s agreement with the City covering all aspects of <br />public improvements, dedications, responsibilities, etc. <br />3. All general development conditions of preliminary approval (i.e. utilities to be underground, <br />lighting to be down directional, plantings to remove metal cages around root balls, etc.) shall <br />continue to be applicable to Final PRD approval. <br />4. The Applicant shall obtain a sign permit from the City prior to construction of monument <br />signage. <br />5. A final landscape plan must be submitted, and Black Hills Spruce shall be replaced with Myers <br />Spruce on the final plans. <br />6. A final lighting plan must be submitted, and all requirements of code shall be met before <br />installations occur.
