If the applicants would like to pursue a formal vacation of the 4th Street right of way, an <br />application from all parties adjacent to the ROW must be submitted along with legal <br />descriptions and exhibits for all necessary replacement easements (private ingress/egress <br />easements, public utility easements, etc.). <br />5. The applicant shall complete needed site clean up to address outdoor storage <br />nonconformities (i.e. the stacks of empty pallets and junk stored east of the building shall <br />be removed). <br />Commissioner Biedenfeld commented outside of the turning radius study being incomplete, the <br />applicant was trying to improve this property. Assistant Director of Community Assets and <br />Development Gozola reported this was the case. He explained this was a complicated site due to its <br />history and the fact that there were legal nonconformities in place. <br />Commissioner Biedenfeld appreciated the fact that the property owner was trying to work through <br />the tough circumstances with the City. <br />Commissioner Nelson asked if the requirements regarding the fence surrounding the outdoor <br />storage should be made a condition for approval. Assistant Director of Community Assets and <br />Development Gozola recommended Condition 6 be added to read: Fencing around the outdoor <br />storage area will be opaque or shall include slates. <br />Commissioner Nelson questioned if the building to the east would have access concerns if additional <br />parking were added. Assistant Director of Community Assets and Development Gozola requested <br />the applicant speak to this question. It was his understanding the additional parking would not have <br />been proposed if it wouldn’t work. <br />Paul Archambeau, Stinson Electric, explained the loading bays on the building to the east were used <br />for transitional storage. He stated he was open to removing the chain link fence noting this would <br />improve emergency vehicle access. He reported he would be engaging a vendor to complete the <br />turning radius study. <br />Commissioner Biedenfeld questioned if the turning radius study could be completed prior to the City <br />Council meeting. Assistant Director of Community Assets and Development Gozola anticipated this <br />would not be completed in time. He explained staff could be directed to review this turning radius <br />study within a condition for approval. This would allow staff to work with the applicant to finalize <br />the plans. <br />Commissioner Biedenfeld commented the City is going to have to default to the public safety <br />requirements for this matter. <br />Acting Chair McQuillan opened the Public Hearing at 7:10 p.m. <br /> <br />
