<br /> <br />9 <br /> <br />Mr. Nelson presented the Commission with a letter from his neighbor Diane Christopherson. <br />Chairperson Nichols Matkaiti requested Mr. Nelson read this letter into the record, since the letter was <br />addressed to Mr. Nelson. <br />Mr. Nelson read the letter from Diane C. Christopherson in full for the record. He explained she would <br />like the Commission to table action on the rezoning in order for the public to be better informed on <br />this matter. <br />Motion by Commissioner McQuillan, seconded by Commissioner Frischman to close the Public <br />Hearing. <br />Approved 7-0. <br />Commissioner Fynewever clarified the Planning Commission was a recommending body and was <br />making a recommendation on the rezoning to the City Council. <br />Motion by Commissioner McQuillan, seconded by Commissioner Murphy, to recommend the City <br />Council adopt Ordinance 865. <br />Approved 7-0. <br /> <br />(b) Adoption of an Ordinance Rezoning property located in the New Brighton Interchange <br />(known as the old New Brighton Elementary School and surrounding lands – specifically PIDs <br />29-30-23-13-0021, 29-30-23-13-0020, 29-30-23-13-0022, 29-30-23-13-0023, 29-30-23-13-0025 <br />and 29-30-23-13-0024) from R-1 and B-3 to R-3B in conformance with the City’s new 2040 <br />Comprehensive Plan. The area is guided for “Mixed Use Neighborhood” development by the <br />new Comprehensive Plan, and the proposed rezoning would allow for consideration of a <br />Planned Residential Development in compliance with the new Comprehensive Plan. <br />Assistant Director of Community Assets and Development Gozola reported State law provides cities <br />with nine months to update zoning ordinances and maps following approval of a new comprehensive <br />plan. The recently approved 2040 Comp Plan has initiated that time clock, and approval of these two <br />ordinances (865 & 866) will be the first step in meeting the City’s legal obligations. Both ordinances <br />are needed at this time to allow developers to initiate the application process. Delaying either project <br />(provided they meet the goals and objectives of the new plan) serves no public purpose. The need for <br />additional housing in the City was discussed. Staff commented further on the Dominium and Pulte <br />project and recommended approval of Ordinance 866 approving the rezoning. It was noted the <br />Ordinance would only grant conditional approval. Gozola acknowledged that most of the speakers <br />tonight have already expressed their opinions regarding this rezoning, but a second public hearing <br />would still need to be opened seeing as the commission was reviewing two separate ordinances. <br />Chairperson Nichols-Matkaiti opened the Public Hearing at 8:57 p.m. No speakers came forward. <br />Motion by Commissioner Frischman, seconded by Commissioner McQuillan to close the Public <br />Hearing. <br />Approved 7-0.
