Page 2 of 2 <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The footprint of the existing home is legal nonconforming to the required front yard setback <br />in the R-1 zoning district; <br />2. The proposed addition to the rear of the home will be conforming to all applicable zoning <br />codes including setbacks. <br />3. The total number of nonconformities (1) cannot be reduced unless the entire home is moved. <br />4. The proposed addition will not have a negative impact the use and enjoyment of surrounding <br />properties. <br />5. Because elimination or reduction of the current legal nonconformity would require the entire <br />structure to be moved, there is no practical way to reduce the existing nonconformity. <br /> <br />BE IT FURTHER RESOLVED, that approval of the special use permit shall be subject to the <br />following condition: <br />1. The Nonconforming Use Permit shall authorize the proposed addition to the rear of the home <br />at 23 15th Ave SW; expansion to other portions of the building would require an amendment <br />of the Nonconforming Use Permit. <br /> <br />ADOPTED this 9th day of April, 2019 by the New Brighton City Council with a vote of __ ayes and <br />__ nays. <br /> <br /> ______________________________ <br /> Valerie Johnson, Mayor <br /> <br /> <br /> ______________________________ <br /> Dean R.
