RESOLUTION ____
CITY COUNCIL
CITY OF NEW BRIGHTON

RESOLUTION AUTHORIZING PUBLICATION OF
ORDINANCE NO. 867 BY TITLE AND SUMMARY

WHEREAS, the city council of the City of New Brighton has adopted Ordinance No. 867, an
ordinance updating code language on zoning enforcement and other enforcement activities relating to
the city’s most common complaints and issues; and
WHEREAS, the ordinance is lengthy; and
WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the City Council believes that the following summary would clearly inform the
public of the intent and effect of the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New
Brighton, that the City Clerk shall cause the following summary of Ordinance No. 867 be published in
the official newspaper in lieu of the entire ordinance:

Public Notice
The City Council of the City of New Brighton has adopted Ordinance No. 867, an ordinance
updating code language on zoning enforcement and other enforcement activities relating to the city’s
most common complaints and issues. Specific changes enacted by the ordinance include extending the
ability to deem a home “unfit for human occupancy” to the Code Compliance Officer; matching up
code language to actual operating practices (i.e. notices being “sent by certified mail” rather than being
“served” to a property owner); simplification of abatement procedures to follow if a property owner
fails to correct a nuisance in a timely fashion; adoption of a clear civil process for the removal of
junk/abandoned vehicles; adoption of new swimming pool standards; and clarification that corner lots
must adhere to trash container standards along both road frontages. The full ordinance text is
available for inspection at City Hall during regular business hours, and will be emailed or sent to any
party upon request.

Mayor Valerie Johnson
