The Applicants shall install a new outlet pipe for Rush Lake as agreed upon with the City <br />Engineer, and shall provide easements in favor of the City over the location of the new line. <br />5. All other changes and actions requested in the City Engineer review memo dated 7/12/19 <br />shall also be implemented prior to any permits being issued or the site of the rubble pile <br />being changed. <br />6. Improvements and requirements listed in Addendum #6 to the Sound Mitigation Plan shall be <br />fully implemented prior to the rubble pile changing location. <br />7. The applicant shall continue to be responsible for keeping public ROW clean of tracked dirt or <br />other materials emanating from their site. <br />Commissioner McQuillan asked if the watershed had approved this request. Assistant Director of <br />Community Assets and Development Gozola stated the watershed district had reviewed the <br />matter but had not yet approved a permit. <br />Anthony Murlowski, Murlowski Properties, explained Rice Creek Watershed visits the site on a <br />monthly basis or after large rain events. He indicated the proposed change to the rubble pile <br />should not impact Rush Lake. He reported the main purposes was to consolidate the land for <br />future purposes. <br />Chair Nichols-Matkaiti opened the public hearing at 6:55 p.m. <br />Paul Kampa, 1150 6th Street NE, asked if the applicant owns the property. Mr. Murlowski <br />explained he does own the property. <br />Motion by Commissioner McQuillan, seconded by Commissioner Frischman, to close the public <br />hearing. <br />Approved 5-0. <br />Motion by Commissioner McQuillan, seconded by Commissioner Melquist, to approve staff <br />recommendation. <br />Approved 5-0. <br />VII. Business Items <br />1) Final Planned Residential Development Review of the proposed final plans for the townhome <br />component of the Midtown Village PRD comprised of 53 market rate townhomes on property <br />to the northeast of Old Highway 8 and 8th Avenue NW – PID 29-30-23-13-0021. <br />Assistant Director of Community Assets and Development Gozola reported Pulte Homes is <br />seeking approval of a Final Planned Residential Development for Phase I of the Midtown Village <br />development. This initial phase will include preparation of the land for develo pment, installation <br />of public improvements, and construction of the 53 market rate townhomes approved by City <br />Council on May 28th, 2019. Staff provided further comment on the request and recommended <br />approval of the Final PRD Review, based on the findings of fact and subject to the following <br />conditions:
