Page 1 of 3 <br /> <br />RESOLUTION <br />STATE OF MINNESOTA <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A NONCONFORMING USE <br />VARIANCE TO AUTHORIZE CONSTRUCTION OF AN ADDITION TO THE HOME <br />LOCATED AT 1820 SKYHIGH DRIVE <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Scott Gordhamer (the “Applicant”) is owner of property 1820 Skyhigh Drive which <br />has the property identification number of 31-30-23-14-0006 and is legally described as: <br /> <br />Lot 8, Block 2, VALLEY VIEW PARK, Ramsey County, Minnesota <br /> <br />and <br /> <br />WHEREAS, the Applicant’s property is guided by the Comprehensive Plan for Low Density <br />Residential, and is zoned R-1 on the City’s zoning map; and <br /> <br />WHEREAS, buildings within the R-1 zoning district are required to be a minimum of 30 feet from <br />adjacent rights-of-way; and <br /> <br />WHEREAS, the existing home, built in 1952, predates City zoning regulation and was built 12 feet <br />within the required 30-foot front yard setback; and <br /> <br />WHEREAS, the Applicant made application to the City on 9/16/19 for a nonconforming use <br />variance to authorize an addition to expand the existing footprint of the home north in a manner that <br />conforms to all zoning requirements except for the existing front yard nonconformity; and <br /> <br />WHEREAS, the footprint of the existing home is slightly skewed and is thus not completely parallel <br />with the road resulting in the proposed addition becoming approximately 3” closer to the road than <br />the existing home; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on October 15, 2019; and <br />
