Murlowski Industrial Park Preliminary & Final Plat <br />Planning Commission Report; 12-17-19 <br /> <br /> <br />Page 4 <br />(cont.) <br /> <br />The clients are requesting a 2 lot final plat. Lot 1 would consist of the existing building owned by Murco Inc. <br />The boundary of Lot 1 will not differ from the current property description for that lot. Lot 2 would consist of <br />and combine the remnant parcels. <br /> <br />As part of this application we are requesting the City of New Brighton waive certain requirements until a final <br />development plan is prepared. Once this phase of the project is complete and the legal descriptions and title <br />is cleaned up we will address final easements, wetland, storm water, engineering, dedication, and other <br />issues as part of a final development plans. <br /> <br /> <br />GENERAL DEVELOPMENT REVIEW <br />Lots and <br />Blocks: <br /> The new plat will not visually change the boundaries between lots (the only real <br />change will be to the legal descriptions of the both lots to ensure they are consistent <br />with one another, and consistent with adjacent property descriptions. No concerns. <br /> <br />Access: Because the applicants are proposing to plat two lots instead of one, staff still must be <br />concerned with ROW dedications that may be necessary to protect access to these and <br />future lots. One of only two concerns that staff has with this application is in regards <br />to this issue. Specifically, the following must be considered: <br /> Lot 1, Block 1 currently has a 30’ roadway easement over the northern boundary <br />of the parcel. A full ROW should be 60’ <br /> To the north of this parcel is Mounds View, so there is no guarantee the City will <br />ever see this half ROW completed, or that our neighboring community would <br />participate in a shared roadway. The best course of action in these situations is to <br />ensure a full roadway can be constructed on this side of the boarder if needed in <br />the future. This would require the existing easement be expanded to 60’ wide. <br /> Expanding the easement to 60’ wide creates potential legal concerns given the <br />location of the existing building on Lot 1, Block 1. Staff is seeking legal input on <br />the best way to proceed, and we are recommending the matter be resolved as <br />directed by legal Counsel moving forward. Due to the holidays, this matter will <br />not go to Council until January 14th, so there is plenty of time for a final easement <br />configuration to be agreed upon and drawn up for approval. <br /> <br />Building <br />Locations: <br /> No new buildings are proposed. Legal counsel will be considering existing structures <br />as it relates to the expanded roadway easement being sought by staff. <br /> <br />Building <br />Heights: <br /> Building heights will not be changing as a result of this application.
