<br />'.' <br /> <br />,j <br /> <br />RESOLUTION NO. 94- 106 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A PORTION OF THE MOUNDS AVENUE <br />NW RIGHT~OF-WAY AND ESTABLISHING A 20 FOOT EASEMENT OVER AN EXISTING WATERMAIN UTILITY PIPE. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1 . Cheetah Precision has submitted a petition, as 100 percent of the property owners <br />involved, to vacate a portion of Mounds Avenue NW right-of-way. <br />2. That the City Council, pursuant to published notices, held a public hearing on the <br />vacation, and all persons present at the hearing were given an opportunity to be heard. <br /> <br />Now, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON makes the <br />following Findings of Fact in respect to the proposed vacation: <br /> <br />1 . The street right-of-way to be vacated is improved but no longer serves a public purpose. <br />2. There are public utilities within the subject street right-of-way. <br />3. A 20 foot utility easement would be established over said utilities. <br /> <br />BE IT FURTHER RESOLVED, the Council hereby vacates that portion of the Mounds Avenue NW <br />right-of-way legally described as follows: <br /> <br />That part of Mounds Avenue as dedicated in the plat of MOUNDS CENTER, which lies <br />Westerly of the Westerly right-of-way line of Interstate Highway No. 35 and which lies <br />Easterly of a line drawn perpendicular to the North line of said Mounds Avenue, from the <br />Southwest corner of Lot 14, Block 4, MOUNDS CENTER, according to the duly recorded <br />plat. <br /> <br />BE IT FURTHER RESOLVED, the City Council hereby establishes a 20 foot utility easement <br />described as follows: <br /> <br />The South 20 feet of the North 30 feet of Mounds Avenue, as dedicated in <br />the plat of MOUNDS CENTER, which lies Westerly of the Westerly <br />right-of-way line of Interstate Highway No. 35 and which lies Easterly of a <br />line drawn perpendicular to the North line of said Mounds Avenue, from the <br />Southwest corner of Lot 14, Block 4, MOUNDS CENTER, according to the <br />duly recorded plat. <br /> <br />Adopted this 27th day of September, 1994. <br /> <br />ATTEST: <br /> <br />~ <br /> <br /> <br /> <br />ATTEST: <br /> <br />Margaret Ega , <br />Finance Director/CIty Clerk <br /> <br />(SEAL) <br />
