Page 2 of 4 <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for light industrial uses, and the existing uses have been <br />approved and amended since 2010. <br />2. Under the currently approved SUP and Site Plan, the use has not generated any official <br />complaints regarding noise, dust, or odors. <br />3. The applicants are currently seeking approval of a preliminary and final plat to clean up the <br />legal descriptions of all land in an effort to position one or more lots for sale. <br />4. All lots are currently served by an inadequate 30-foot wide roadway easement across the <br />northern property line. <br />5. As a condition of approval for the proposed preliminary and final plat, the applicants were <br />required to show access to the proposed Lot 2 could be independently obtained through <br />means other than the inadequate 30-foot wide roadway easement. <br />6. The plans provided by the applicant in this application have been acknowledged by all <br />interested parties (Ramsey County, MnDOT, the railroad, RCWD, etc) as being a realistic <br />alternative to roadway access in the future for Lot 2. <br />7. Previous conditions of approval for the SUP and Site Plan must be amended to allow for this <br />potential future roadway access. <br />8. No road will be designed or constructed until such time as the landowners decide to move <br />forward with development of Lot 2 <br />9. A variance to lot frontage for Lot 1 is justified as the plans clearly demonstrate that adequate <br />options exist to provide roadway access to all proposed properties. <br />10. The special use will continue to conform with all provisions of the Environmental Constraint <br />Overlay Area by following all existing and amended conditions of approval. <br /> <br />BE IT FURTHER RESOLVED, that approval of the special use permit amendment shall be <br />subject to the following conditions: <br />1. All previous conditions of approval applicable to this site, unless specifically changed by this <br />SUP amendment, shall remain in effect as part of this amendment. <br />2. All previous conditions requiring the chimney portion of the property (Outlot A) be kept in a <br />natural state are hereby repealed, and the area may be utilized for ingress/egress purposes. <br />3. Future construction/design of a road through Outlot A shall strive to preserve existing <br />vegetation on both sides of the railroad tracks in as much as possible. <br />4. The applicant shall dedicate an easement over the storm water pipe and lake outlet extending <br />northward from Rush Lake as directed by the City Engineer. <br /> <br />
