REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: Consider Ordinance 873: An ordinance to conditionally rezone a property in <br />compliance with the 2040 Comprehensive Plan. <br />DEPARTMENT HEAD’S APPROVAL: <br />CITY MANAGER’S APPROVAL: <br />No comments to supplement this report ___ Comments attached ___ <br />15.99 Deadline: n/a <br />Recommendation: Approval of Ordinance 873 <br />Legislative History: 2040 Comprehensive Plan Update initiated in 2016 <br />New Plan written between 2016 and 2018 based on significant public <br />input throughout the two-year period <br />2040 Comp Plan approved by the Met Council Met Council in 2019; guides <br />subject parcel for Mixed Use Regional. <br />Financial Impact: Not completing the requested rezoning at this time would unnecessarily <br />delay consideration of the proposed development which in turn could lead to <br />higher project costs and lost tax revenue. <br />Summary: State law provides cities with nine months to update zoning ordinances and <br />maps following approval of a new comprehensive plan. The recently <br />approved 2040 Comp Plan initiated that time clock, and the City undertook an <br />effort to update zoning classifications throughout the City in compliance with <br />the new plan. Some areas, like the subject parcel, were deemed to have <br />compliant zoning as the City has yet to establish new zoning for its mixed use <br />areas, and applicant’s could request a rezoning should they come forward <br />with a PRD application to fulfill the Comp Plan goals. <br />In 2019, the Benedictine Health Center requested and received approval of <br />rezoning for two parcels adjacent to their campus, and subsequently gained <br />approval of a PRD to expand their facility. Following those approvals, the <br />Benedictine’s were presented with an opportunity to acquire the parcel <br />subject to this application, and they’ve elected to re-examine their PRD to <br />incorporate this additional land.
