Final Planned Residential Development
Planning Commission Report; 5-19-20

Page 5
(cont.)  In addition to ensuring the development plans comply with preliminary approvals,
the Planning Commission and Council are to examine the final plat to determine
compliance with the City’s subdivision codes in Chapter 26.
o Was the final plat received within one year of preliminary approval (or within
one year of the last phase being approved)?
Yes. Phase II was approved on November 26th, 2019.
o Was the final plat prepared by a land surveyor, and do the documents
conform to all State and County requirements?
Yes. The proposed plat was prepared by Max L. Stanislowski, Licensed Land
Surveyor, and the City Attorney has confirmed the final plat is in order with
only minor corrections needed.
o Do the final plat documents provide all information to be shown as called for
by Section 26-41(2) of the City’s Subdivision Codes?
Yes. All necessary information is shown on the final plat.
o Are park dedication requirements being met by the final plat?
Yes. Dedication will be satisfied via cash-in-lieu of land per a developer’s
agreement being prepared. Per the Preliminary PRD approval, the dedication
will be $372,300 for the senior building. It is anticipated that some of this
dedication will be used to build out the public park dedicated as part of Phase
I next spring/summer.
o Has a title opinion been provided and reviewed by the City Attorney?
On-going. The applicant and City attorney are working to complete this step
as of the penning of this report. As the City is and has been the landowner for
multiple years now and the title has been previously reviewed, concerns over
possible issues are negligible.
Based on these criteria, staff does find the final PLAT to be in substantial
compliance with subdivision requirements and preliminary approval.

PC Role at this
time:
 Section 7-090(6) reads:
“The Planning Commission shall indicate by recommendation to the City Council
that the final plan for planned residential development is in substantial compliance
with the preliminary plan and shall add any further conditions it deems necessary
to protect the public health, safety, morals, and general welfare. Any final plan
deemed not to be in substantial compliance with the preliminary plan or in
compliance with Chapter 26 of the City Code except as changed by variation noted
by the applicant shall be as noted in the recommendation to the City Council as to
exactly where the final plan is not in compliance and to what degree and shall
further recommend as to whether another public hearing is in order.”
