Page 1 of 3 <br /> <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AUTHORIZING OUTDOOR STORAGE OF LANDSCAPING MATERIALS AND CARGO <br />CONTAINERS AT 761 1ST STREET SW <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, W A Kirkpatrick, LLC, owns the property located at 761 1st Street SW legally <br />described as: <br /><to be filled in> <br /> <br />WHEREAS, W A Kirkpatrick, LLC (the “Applicants”) made application to the City on 5/14/19 for <br />a Special Use Permit (SUP) to authorize outdoor storage for two businesses at 761 1st Street SW; <br /> <br />WHEREAS, A Tree Service is seeking authorization to store landscaping materials and business <br />vehicles outdoors, and Big Blue Box is seeking authorization to store cargo containers outdoors; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on June 16, 2020; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the June 16th, 2020, <br />meeting and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on June 16th, 2020, <br />based on the applicant’s submittals and findings of fact; and <br /> <br />WHEREAS, the City Council considered on June 23rd, 2020, the recommendations of the Planning <br />Commission, Staff, the Applicant's submissions, the contents of the staff report, and other evidence <br />available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The proposed outdoor storage will not be detrimental to the public health or general welfare <br />provided all materials are stored per an approved plan and all conditions are met;
