Page 1 of 2 <br /> <br />RESOLUTION NO. _____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING A REQUESTED SIDE YARD <br />SETBACK VARIANCE TO CONSTRUCT A PATIO AS REQUESTED BY CAPITAL <br />PARTNERS MANAGEMENT AND WILSON WOLF AT 2100 OLD HIGHWAY 8 <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br />WHEREAS, Capital Partners Management and Wilson Wolf (the “Applicant”) are the owner and <br />tenant respectively at 2100 Old Highway 8 which has the property identification number of 17-30- <br />23-41-0003; and <br />WHEREAS, the Applicant’s property is guided by the Comprehensive Plan for Light Industrial use, <br />and is zoned I-1 on the City’s official zoning map; and <br />WHEREAS, structures are required to meet a 15 foot side yard setback in the I-1 zoning district; <br />and <br />WHEREAS, the existing building at 2100 Old Highway 8 is built up against the side yard setback <br />leaving no room for structures north of the building; and <br />WHEREAS, the applicants are seeking to build a patio to the north of the building all the way to the <br />lot line; and <br />WHEREAS, the patio will include a permanent BBQ and permanent pergola along with seating for <br />up to twenty people and therefor is qualifies as a structure as defined by the New Brighton zoning <br />ordinance; and <br />WHEREAS, the desired patio location requires a 15-foot variance from the required 15-foot side <br />yard setback, and a complete application for such was submitted on 7/24/20; and <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on August 18, 2020 meeting; and <br />WHEREAS, the Planning Commission held a public hearing on the request at the August 18th <br />meeting and considered input from residents; and
