Nonconforming Use Variance Request – Valtinson Sign (386 Cleveland Avenue) <br />Planning Commission Report; 8-18-20 <br /> <br /> <br />Page 10 <br />Analysis <br />Summary: <br /> Code criteria for a variance and to change a legal nonconforming use cannot be met <br />to allow for an increase in sign size. <br /> Reduction in the size of the sign from approximately 40 square feet to a conforming <br />overall size can be used to justify a height variance and the proposed type & face <br />changes to the legal nonconforming use. <br /> <br /> <br />Supplementary Review & Public Comment <br />Additional <br />Information: <br /> The applicant’s sign company has determined that the bottom of any sign, regardless <br />of dimension ratios, will need to be 25’ above grade to be visible over the sound <br />wall. <br /> Based on the proposed sign configurations, a 36 square foot sign will be <br />approximately 7’ x 5’, or 6’ x 6’ in size. <br />o A 7’ x 5’ sign with a button 25’ above grade will require a 10-foot variance to <br />height. <br />o A 6’ x 6’ sign with its bottom 25’ above grade will require an 11-foot variance <br />to height. <br /> Billboards (i.e., signs that advertise things other than the business on the premises) <br />are not allowed in the B-1 district. As the applicant is proposing to erect a dynamic <br />electronic display, one condition of any approval will be no advertising for anything <br />but the business specifically on the premises. <br /> <br />Engineering <br />Review: <br /> Engineering reviewed the proposed plans for the addition and had no comments or <br />concerns. <br /> <br />Public Safety <br />Review: <br /> No comments or concerns. <br /> <br />Public <br />Comment: <br /> MnDOT indicated they do not comment on this type of sign, and would only get <br />involved if the sign could be used as a billboard <br /> No other comments were received as of 8/13/20. <br /> <br /> <br /> <br /> <br />
