Page 1 of 4 <br /> <br />RESOLUTION NO. _____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING REQUESTED VARIANCES <br />TO SIGN SIZE AND HEIGHT REQUIREMENTS, BUT APPROVING A LESSER HEIGHT <br />VARIANCE TO AUTHORIZE CONSTRUCTION OF A DYNAMIC ELECTRONIC GROUND <br />SIGN AT 386 CLEVELAND AVENUE <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Lauris Valtinson (the “Applicant”) is owner of property at 386 Cleveland Avenue SW <br />which has the property identification number of 32-30-23-14-0017 and is legally described as: <br /> <br />The North 300.00 feet, except therefrom the Northerly 205.68 feet of that part of the South 10 acres of <br />the Southeast Quarter or the Northeast Quarter of Section 32, Township 30, Range 23, Ramsey <br />County, Minnesota, lying Easterly of State Trunk Highway 394. <br /> <br />and <br /> <br />WHEREAS, the Applicant’s property is guided by the Comprehensive Plan for Commercial use, <br />and is zoned B-1 on the City’s official zoning map; and <br /> <br />WHEREAS, business signs in the B-1 district must be 10-feet from property lines abutting roads, <br />not exceed 25 feet in height, and not exceed 36 square feet in area; and <br /> <br />WHEREAS, in 2003, the city mistakenly permitted a 40 square foot wall sign which, because it is <br />only visible from a freeway, should not have been permitted as Freeway signs were not allowed in <br />the B-1 district in 2003; and <br /> <br />WHEREAS, the sign is considered legal nonconforming; and <br /> <br />WHEREAS, in 2020, MnDOT began construction of a sound wall on I-35W that will block view of <br />the legal nonconforming wall sign from the freeway; and <br /> <br /> <br />
