REQUEST FOR COMMISSION CONSIDERATION

ITEM DESCRIPTION: Consider Ordinance 877: An ordinance identifying and establishing certain
interim uses and the process for the issuance of interim use permits
DEPARTMENT HEAD’S APPROVAL:
CITY MANAGER’S APPROVAL:
No comments to supplement this report ___ Comments attached ___

15.99 Deadline: n/a
Recommendation: Approval of Ordinance 877
Legislative History:  Planning Commission and Council review variance request from Wilson
Wolf seeking to build a patio in a location that works great today, but is
expected to have issues at an undertermined time in the future.
 Both the Commission and Council agree a variance is not warranted, but
both also agree this would be a good issue to address with interim use
permits.
 Staff directed to create the tool within the New Brighton zoning ordinance
in August of 2020.
Financial Impact: None
Summary:  Cities are allowed to use a number of tools established by State Statute
for overseeing land uses within their borders. One such tool, the “Interim
Use Permit,” is especially useful in situations where the City would like to
permit a use, but also identify a specific sunset date or trigger that would
end the use. A recent land use application before the City highlighted the
fact that Interim Use Permits currently cannot be issued as the New
Brighton Zoning Ordinance has never been amended to include the tool.
Ordinance 877 would rectify this omission.

________________________
Ben Gozola, AICP
Assistant Director of Community Assets and Development
Report Number: 2
Agenda Section: VI
Report Date: 9/9/20
Council Meeting Date: 9/15/20
