RESOLUTION ____ <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br /> <br />RESOLUTION AUTHORIZING PUBLICATION OF <br />ORDINANCE NO. 877 BY TITLE AND SUMMARY <br /> <br /> WHEREAS, the city council of the City of New Brighton has adopted Ordinance No. 877, an <br />ordinance identifying and establishing certain interim uses and the process for the issuance of interim <br />use permits; and <br /> WHEREAS, the ordinance is lengthy; and <br /> WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and <br />summary in the case of lengthy ordinances or those containing charts or maps; and <br /> WHEREAS, the City Council believes that the following summary would clearly inform the <br />public of the intent and effect of the ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />Brighton, that the City Clerk shall cause the following summary of Ordinance No. 877 be published in <br />the official newspaper in lieu of the entire ordinance: <br /> <br />Public Notice <br />The City Council of the City of New Brighton has adopted Ordinance No. 877, an ordinance <br />identifying and establishing certain interim uses and the process for the issuance of interim use permits <br />within the City of New Brighton. An interim use permit (IUP) is a tool the City can use to authorize <br />defined land uses on a temporary basis with assurance that the use will terminate upon a specific <br />date or triggering event. Applicants for an interim use permit would follow the procedures <br />established by Ordinance No. 877 to seek approval of their proposed use. If approved, the IUP <br />would be subject to conditions including a specific trigger for termination of the use. As part of <br />Ordinance 877, two potential interim uses are established: accessibility improvements for residential <br />structures, and outdoor recreational improvements such as patios, pergolas, or barbeque/grill <br />stations within required side or rear yard setbacks of the I-1 zoning district. Further uses eligible for <br />IUP consideration would need to be established by future ordinances.
