REQUEST FOR COMMISISON CONSIDERATION ITEM DESCRIPTION: Variance & Site Plan Review: Request from Lauris Valtinson for one variance to accommodate a replacement sign to project above the new MnDOT sound wall on I-35W for the business at 388 Cleveland Avenue SW. The single variance seeks to exceed the 20’ sign-height maximum by 12 feet – PID 32-30-23-14-0016. DEPARTMENT HEAD’S APPROVAL: CITY MANAGER’S APPROVAL: No comments to supplement this report ___ Comments attached ___ 15.99 Deadline: 12/15/2020 (extended by the applicant via letter dated 8/26/20) Recommendations: Staff believes the variance as requested should be APPROVED. Template motions, recommended findings, and suggested conditions can be found on pages 11 – 12. Legislative History: Initial application components received on 7/17/20 Application deemed incomplete on 7/23/20 Revised site plan to complete the application for two variances was received on 7/28/20 Planning Commission Public Hearing held on 8/18/20, and Commission recommends denial of both variances City Council review held on 8/24/20, and applicant agrees to a tabling of the request to allow him an opportunity to eliminate one of the requested variances. Council directs any revised application back to the PC. 8/26/20 letter from the applicant extends 60-day rule out to mid December providing plenty of time to amend the application and complete review. 9/9/20: new sign plan received for review requesting only a height variance. Financial Impact: None Summary: Lauris Valtinson acquired the property at 386 Cleveland Avenue in 2015 which included a legal nonconforming freeway sign facing I-35W. With the new sound wall now going up, Mr. Valtinson is seeking a way to keep the legal nonconforming sign visible once the wall is up.
