Nonconforming Use Variance Request – Valtinson Sign (388 Cleveland Avenue)
Planning Commission Report; 9-15-20

Page 5
Notable Updates/Changes
Council Review: The City Council reviewed the original application and Planning Commission
recommendations at the 8/24/20 Council meeting, and informed the applicant
that they shared many concerns expressed by the Commission. As part of the
discussion, the applicant agreed to extend the review timeline in exchange for an
opportunity to amend the application in an effort to address the main concerns.
Council was amenable to that request, but informed the applicant he must return
to the Planning Commission for further review of any revised proposal.

Sign updates: The applicant has revised the application to only request a height variance to get
a conforming sized sign above the wall.
The new sign will be just under 4 feet high, and just over 9 feet wide (9’ - 4 3/16”
x 3’ - 7 7/16”). Like the first proposal, the bottom of the sign must be 25’ off the
ground to be visible over the wall, so the total height of the sign will be 29’
rounded up.

Parcel Changes Since the original application was received, the landowner has legally combined
the subject parcel with an undeveloped parcel to the north. Assuming a proposed
site plan to allow construction of a new garage is approved, the new building
should be factored into any potential visual concerns relating to this sign
proposal.

General Findings
Site Data: Existing Lot Size ≈ 0.96 acres
Existing Use – Small office building
Existing Zoning – B-1
Property Identification Number (PID): 32-30-23-14-0017

Comp Plan
Guidance:
The comprehensive plan guides this property for Commercial (C) use. The
existing business is an appropriate use in this district.

Notable Code
Definitions:

Billboard. A free-standing sign that directs attention to a business, commodity,
service, or entertainment not exclusively related to the premises where the sign
is located or to which it is affixed, or a structure designed to display or support
such a sign.
