Nonconforming Use Variance Request – Valtinson Sign (388 Cleveland Avenue) <br />Planning Commission Report; 9-15-20 <br /> <br /> <br />Page 10 <br />Public <br />Comment: <br /> MnDOT indicated they do not comment on this type of sign, and would only get <br />involved if the sign could be used as a billboard <br /> One phone call was received from an unidentified home owner “across the street” <br />who voiced opposition to the sign citing concerns about visual impact and <br />potentially noise. <br /> Two emails in opposition to the variance requests were received on 8/17/20 and <br />8/18/20. Both emails were read to the Planning Commission on 8/18/20, and are <br />included in the packet following this report. <br /> <br />Staff Rec:  Approval of a 9-foot height variance to accommodate a conforming, ≈35 square <br />foot sign. <br /> <br /> <br />Conclusion: <br /> The applicant is requesting a 9-foot variance from the 20’ height maximum for a <br />ground sign in the B-1 zoning district. <br /> <br />Commission <br />Options: <br />The Planning Commission has the following options: <br />A) RECOMMEND APPROVAL OF THE REQUEST based on the <br />applicant’s submittals and findings of fact. <br />B) RECOMMEND DENIAL OF THE REQUEST based on the applicant’s <br />submittals and findings of fact. <br />C) TABLE THE ITEM and request additional information. <br />The applicant provided the City with a written extention to the 60-day rule out to <br />December 15, 2020, to make a final decision on this request.
