1 <br />RESOLUTION NO. _____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />FOR 1546 16TH TERRACE NW TO AUTHORIZE CONSTRUCTION OF AN ACCESSORY <br />BUILDING IN EXCESS OF 624 SQUARE FEET <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Paul and Sara Apliklowski (the “Applicants”) made application to the City on 9/14/20 <br />for a special use permit to authorize construction of an accessory structure in excess of 624 square <br />feet for the property at 1546 16th Terrace NW which is legally describe as: <br />THE SOUTH 300 FT OF NORTH 959.3 FT OF EAST 97.6 FT WEST 361.6 FT OF NW ¼ <br />SEC 20, T.30, R.23, SUBJ TO ROAD, RAMSEY COUNTY, MN. <br />and <br /> <br />WHEREAS, the new accessory structure will meet all required setbacks and will be conforming to <br />codes in every way; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission on October 20th, 2020; and <br />WHEREAS, the Planning Commission held a public hearing on the request at the October 20th <br />meeting and considered input from residents; and <br />WHEREAS, the Planning Commission recommended approval of the request based on the <br />applicant’s submittals and findings of fact; and <br />WHEREAS, the City Council considered on October 27th, 2020, the recommendations of the <br />Planning Commission, staff, the Applicant's submissions, the contents of the staff report, and other <br />evidence available to the Council. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for residential use by the comprehensive plan, and a detached <br />garage in excess of 624 square feet can be permitted via a special use permit in the <br />corresponding R-1 zoning district.
