<br /> <br /> <br />REQUEST FOR COMMISISON CONSIDERATION <br /> <br />ITEM DESCRIPTION: Site Plan and Nonconforming Use Variance Review: Request Jamatar II LLC and <br />Everest Properties LLC to rearrange past shared parking arrangements and <br />easements to optimize use of all landholdings – 441 Old Highway 8, 750 4th St <br />NW, and 755 4th St NW – PIDs: 29-30-23-42-0022, 29-30-23-42-0023, 29-30-23- <br />42-0025 and 29-30-23-42-0024. <br />DEPARTMENT HEAD’S APPROVAL: <br />CITY MANAGER’S APPROVAL: <br />No comments to supplement this report ___ Comments attached ___ <br /> <br />15.99 Deadline: 1/28/2021 (extended by staff via letter dated 11/10/20) <br />Recommendations:  Staff believes the variance and site plan as requested should be <br />CONDITIONALLY APPROVED. <br /> Template motions, recommended findings, and suggested conditions can <br />be found on pages 14 & 15. <br />Legislative History:  Many of the existing improvements on these various sites were approved <br />in the 60’s and 70’s prior to zoning being in place. <br /> Early 90’s, land was split up and the parcels sold to different parties. <br /> Late 90’s, disputes between the new owners resulted in a settlement that <br />created several easements for ingress/egress & parking <br /> 2020: owners of these parcels agree the former arrangement is not <br />working, and they propose this site plan review and variance to facilitate <br />an equitable and more efficient use of all properties. <br />Financial Impact: None <br />Summary: This area of the City has significant history dating back before our present <br />zoning code resulting in multiple legal nonconformities and an arrangement <br />of uses that would not occur under present development standards. The <br />present property owners have determined that “fixes” put in place to address <br />parking issues over 20 years ago are not operating as intended, and are <br />preventing efficient use of the land in this area.
