Planning Report <br />Site Plan and Nonconforming Use Variance Review <br /> <br /> <br />To: Planning Commission <br />From: Ben Gozola, Assistant Director DCAD <br />Meeting Date: 11-17-20 <br />Applicants: Jamatar II LLC and Everest Properties LLC <br />Main Contacts: Paul Archambault <br />Location: 441 Old Highway 8, 750 4th St NW, & 755 4th St NW <br />Zoning: I-1 <br /> <br /> <br />Introductory Information <br />Project: Per the applicant, all three properties involved in this application were built and <br />occupied by the Murlowski family and Belair Builders Inc in the 1960’s and 1970’s. In <br />1992 to 1993, the Murlowskis divided the parcels and sold them to three separate <br />owners. In 1997, a series of disputes about parking and ingress/egress culminated in a <br />settlement that created several easements and provided Everest Properteis a parking <br />easement on property now owned and maintained by JAMATAR II. Historically the <br />parcel has not been used for Everest parking due to the distance from their buidlng and <br />lack of visibility from their parking lot. Everest tenants and guests have used other <br />parking spaces within the ROW for 4th St. NW, or on unmarked spaces at 750 4th St <br />NW to the south of the striped parking area and in the access easement. <br />In summary, the 20+ year old easements are not operating as intended and are not <br />desireable for the current landowners of the area parcels. Accordingly, the landowners <br />are before the City with a site plan review requesting authorization to amend the <br />easements as discussed herein. <br /> <br />History: History prior to 2020 noted above. <br /> March 2020: Paul Archambault contacts the City with interest in how to amend <br />parking easements between properties in this area. The onset of COVID and the <br />subsequent lock-down ends further discussion on the subject. <br /> August 2020: Paul contacts the City stating he’d like to revive discussions and learn <br />how to proceed with fixing the parking easements. Staff outlines process to proceed <br />with a site plan review to authorize a new exchange of easements. <br /> <br />
