Page 1 of 3 <br /> <br />RESOLUTION NO. _____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN <br />AMENDMENT AND NONCONFORMING USE VARIANCE TO AUTHORIZE A <br />RECONFIGURATION OF PARKING BETWEEN THE PROPERTIES AT 441 OLD HIGHWAY <br />8, 750 4TH STREET NW, AND 755 4TH STREET NW <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Paul Archambault on behalf of JAMATAR II LLC and John Higgins on behalf of <br />Everest Properties LLC (the “Applicants”) made application to the City on 9/30/20 for a site plan <br />review and nonconforming use variance to authorize a reconfiguration of parking and land use <br />between the properties at 441 Old Highway 8, 750 4th Street NW, and 755 4th Street NW, which <br />have the following property identification numbers: 29-30-23-42-0022, 29-30-23-42-0023, 29-30- <br />23-42-0025 and 29-30-23-42-0024; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on November 17, 2020; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the November 17th <br />meeting and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on November 17th <br />based on the applicant’s submittals and findings of fact; and <br /> <br />WHEREAS, the City Council considered on November 24th, 2020, the recommendations of the <br />Planning Commission, Staff, the Applicant's submissions, the contents of the staff report, and other <br />evidence available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested site plan and nonconforming use variance to authorize a <br />reconfiguration of parking and land use on the subject properties based on the following findings of <br />fact: <br />1. Legal nonconforming improvements (some of which predate the current zoning ordinance) <br />on these properties have been previously authorized by City approvals.
