Given the late date of application in September, we were unable to schedule <br />review of this matter in October, and we are presently on target for a November 17th review by the <br />Planning Commission and a November 24th review by the City Council. As you know, our review of the <br />application materials in October resulted in the City Engineer requesting additional surveying, drainage, <br />and turning movement data which has not been received as of 11/10/20. The absence of the requested <br />information a week before the anticipated Planning Commission review calls into question whether the <br />currently projected timeline is achievable. Assuming we receive the information yet this week, we will <br />do everything possible to follow the desired timeline. <br />By state statute, the City is required to take action on your request within 60-days of your application <br />date. If more time is needed, a City is allowed to extend the review period out an additional 60 days. <br />Based on your application submittal of 9/30/20, the current deadline for a decision is 11/29/20. <br />Because we anticipate the possibility of not having enough time to review your updated engineering <br />information, and because we can never guarantee quorums at upcoming meetings, staff is electing to <br />extend the City’s decision deadline under MN Statute 15.99 out an additional 60-days. If needed, these <br />additional review days will provide staff with time necessary to fully review your new data and prepare <br />reports for the Planning Commission and City Council. With this extension, the new deadline for a final <br />decision is January 28th, 2021, but we will do everything possible to get you a decision at the earliest <br />possible date. <br />
