REQUEST FOR COUNCIL CONSIDERATION

ITEM DESCRIPTION: Consider Resolution Approving Quit Claim deeds for Murlowski
Properties, Inc. to clean up title issues with adjacent properties
DEPARTMENT HEAD’S APPROVAL:
CITY MANAGER’S APPROVAL:
No comments to supplement this report ___ Comments attached ___

15.99 Deadline: Not applicable.
Recommendations:  Approval of the resolution authorizing filing of quit claim deeds for
Murlowski Properties, Inc.
Legislative History:  Application for Preliminary & Final Plat received on 11/13/19, and
subsequent application for a needed Site Plan Amendment received on
2/14/20; both applications are pending review and approval once meetings
can be held again.
 Request to approve quit claim deeds received in early March; staff
researched code and the City’s past files for these types of requests, and
concluded minor legal description corrections such as this between willing
& adjacent landowners technically falls outside of the definition of
“subdivision,” and have historically been approved via Council resolution.
 Resolution prepared for Council action on 3/19/20.
Financial Impact: None. This is an interim step being taken by the Murlowskis to clean up
various issues with adjacent properties prior to their proposed plat and site
plan amendment (potentially) being approved in the coming months.
Summary: Murlowski Properties Inc is seeking Council authorization of the attached quit
claim deeds. By code, minor legal description amendments like these
between willing & adjacent landowners do not need to go through the full
subdivision process, but still need Council approval before they can be filed at
the County. In researching the City’s history with these types of requests,
they’ve also been approved by a simple motion & second in the past. Staff
prefers the City memorialize decisions on these requests via resolution
instead, hence the item before Council tonight.
