Ordinance to Establish Temporary Use Regulations
City Council Review; 5-26-20

Page 3
PLANNING COMMISSION REVIEW
The Planning Commission reviewed Ordinance 874 at their meeting on 5/19/20, and held a public hearing to get
feedback on the language. The commissioners were grateful that the City was taking proactive steps to assist our
residents and businesses, and supported the provisions as proposed.
The Planning Commission ultimately recommended approval of Ord 874 by unanimous vote.
RECOMMENDATION
Both the Planning Commission and Staff are recommending approval of Ordinance 874 based on the following:
 Staff has already received one request for an outdoor seating area, and re-opening of the state will likely spur
more such requests.
 Businesses are already under significant financial burdens, and requiring them to go through an expensive and
lengthy process for outdoor seating will not help them recover in this critical time.
 The Department of Community Assets & Development has expertise in-house to review the proposed temporary
uses, and identify conditions for temporary approval. Issues can be addressed with businesses on an on-going
basis, and no use authorized via this process would become permanent.
ACTION ITEMS (3)
1.
