4. LIMITATION ON LIABILITY. NOTWITHSTANDING ANY PROVISION IN THE LEASE OR THIS <br />AMENDMENT TO THE CONTRARY, NEITHER PARTY SHALL BE LIABLE OR RESPONSIBLE TO <br />THE OTHER, OR ITS AFFILIATES OR CUSTOMERS, FOR ANY SPECIAL, INCIDENTAL, INDIRECT, <br />PUNITIVE OR CONSEQUENTIAL COSTS, LIABILITIES OR DAMAGES, WHETHER FORESEEABLE <br />OR NOT, INCLUDING WITHOUT LIMITATION ECONOMIC LOSS OR LOST BUSINESS OR PROFITS, <br />INTERRUPTION OF SERVICE DAMAGES, OR ANY DELAY, ERROR OR LOSS OF DATA OR <br />INFORMATION ARISING IN ANY MANNER OUT OF, OR IN CONNECTION WITH USE OF THE <br />PREMISES. Nothing herein shall change or otherwise affect the Landlord's liability limits established under <br />Minn.
