SEARCHES OF VEHICLES AND PERSONS <br />Officers conduct searches in strict observance of the constitutional rights of persons being searched. All searches must <br />comply with relevant federal and state laws governing the seizure of persons and property. Generally, officers can <br />legally search a vehicle or person without a warrant only for the following reasons: <br />■ Contraband in plain view <br />■ Medical emergency/life-saving needs <br />■ When probable cause is established to believe there is evidence of a crime on a person or inside a vehicle <br />■ As part of a protective sweep for weapons (must have reasonable suspicion based on specific facts that there <br />may be a weapon inside the vehicle or on the person) <br />■ A search incident to arrest <br />■ To conduct an inventory of the vehicle or person <br />■ With the consent of the individual—or in the case of a vehicle, the driver and/or registered owner—when there <br />is reasonable suspicion of criminal activity beyond the traffic violation <br />An officer may also conduct a "Terry Search" of a stopped person if the officer reasonably believes, based on specific and <br />articulable facts, that the person may be armed and dangerous. A Terry Search is limited to a pat down of the person's <br />outer clothing for weapons. <br />In 2019, Roseville officers searched vehicles during 135 traffic stops (3.3x/0) and searched persons in 170 incidents <br />(4.1%). <br />Vehicle & Person Searches during Traffic Stops, 2019 <br />n=4123 <br />Figure 2 - Vehicle & Person Searches during Traffic Stops <br />RESULT OF THE STOP <br />Other, <br />186,4% <br />Vehicle Only, 16, 0% <br />Per Roseville Police Department policy and Minnesota state statutes (Minn. Stat. § 169.985; Minn. Stat. § 299D.08), there <br />are no ticket quotas for officers to meet and the number of citations issued by any officer is not used when evaluating <br />officer performance. There are also no mandatory procedures requiring officers to issue tickets under certain <br />circumstances; whether a traffic stop results in a citation or a warning—either written or verbal—is wholly at the <br />discretion of the officer conducting the stop.
