First offense requires owner to take actions necessary to prevent further violations. <br />Second offense within 365 days of an initial violation results in immediate permit suspension <br />and review by Council. Council can reinstate, amend conditions, or revoke after a public <br />hearing. Properties with revoked permits cannot obtain a new permit for 365 days. Persons <br />who have a permit revoked cannot be issued a new short-term rental permit for 365 day. Staff <br />commented further on the proposed Ordinance and explained staff would be taking comment <br />from the public and Council this evening. It was noted the Ordinance would be formally <br />approved on April 13, 2021. <br />Mayor Niedfeldt-Thomas thanked Assistant Director of Community Assets and Development Gozola <br />for his efforts on this Ordinance. <br />Gregg Tranowski,1321 Mississippi Street, asked why a 10 person occupancy limit was removed from the <br />Ordinance. He stated he was concerned that not having a maximum occupancy would overwhelm the <br />adjacent neighbors. He noted he and his neighbors supported the City moving forward with a short term <br />rental ordinance. <br />Martin Barklow, 2169 Lake Brook Drive, commented he lived three or four houses down from the problem <br />property. He indicated the problem property owner was not in attendance at this meeting. He discussed the <br />difference between a permit and a license. He suggested the City consider having a license with a higher fee <br />in order to allow the City to address safety and fire concerns. He reported the rental property in his <br />neighborhood was out of control and explained the lude parties were negatively impacting the residents. He <br />encouraged the Council to consider more strict language, recommending all parking be required to be placed <br />on rental property overnight. <br />Sarah Gabler, 2190 Lake Brook Drive, stated she lived two houses down fiom the problem rental property. <br />She thanked the Council for bringing this Ordinance forward and for addressing this concern. She explained <br />this rental property has been a nuisance for the neighborhood and the gun that was discharged was right in <br />front of her house at 3:30 am. She questioned if a list of violations would be kept for problem properties in <br />order to get them to the two infractions. <br />Joel, 2186 Lake Brooke Drive, stated he was the immediate neighbor to the rental home on Lake Brook <br />Drive. He appreciated what the Council was doing. He recommended the Council be allowed to revise the <br />Ordinance in the future if additional concerns were to arise regarding parking or noise. <br />Leslie, 2186 Lake Brook Drive, commented she supported the proposed Ordinance. She noted the city of <br />Roseville had a 10 day stay rule and suggested New Brighton consider this requirement. She discussed the <br />large amount of traffic and noise that was created by the short term rental in her neighborhood. <br />Rachel Long, 2178 Lake Brook Drive, stated she was a neighbor to the problem rental property. She <br />requested the City consider regulations regarding parking, large gatherings, weddings and parties within short <br />term rentals. She explained the rental home had a large party when a curfew was in place in the City. She <br />noted the police were called and was concerned that the large gathering was allowed to remain in place even <br />though none of the people owned the property. <br />Tom Long, 2178 Lake Brook Drive, questioned how the City would verify if someone was on premises <br />when rooms were rented. <br />Assistant Director of Community Assets and Development Gozola explained he received an email from Tim <br />asking if an Ordinance could be made for one house in the City or was this Ordinance addressing short term <br />rentals in the entire City. <br />Mayor Niedfeldt-Thomas asked for additional comments, there were none. <br />Motion by Councilmember Allen, seconded by Councilmember Dunsworth to close the <br />Public Hearing. <br />A roll call vote was taken. <br />5 Ayes, 0 Nays - Motion Carried <br />
