Consider Resolution to Vacate portions of a cul-de-sac on 7th Avenue NW, and cul-de-sac on 7ch <br /> Vacation of a portion of 7th Street NW adjacent to the Midtown Village Avenue NW,and <br /> Vacation of a portion <br /> Development. of 7ch Street NW <br /> adjacent to the <br /> Motion by Councihnember Jacobsen,seconded by Councilmember Burg to adopt a Resolution Midtown Village <br /> Development. <br /> approving the partial right-of-way vacations to portions of a cul-de-sac on 7th Avenue NW,and <br /> Vacation of a portion of 7th Street NW adjacent to the Midtown Village Development as <br /> part of the recent Midtown Village Phase I(Pulte)approval. <br /> City Manager Lotter indicated Assistant Director of Community Assets and Development Gozola would be <br /> presenting this item to the Council. <br /> Assistant Director of Community Assets and Development Gozola stated as part of the Preliminary PRD <br /> review for the Midtown Village development,it was determined that the City should move forward with a <br /> vacation of unused cul-de-sac right-of-way on 7th Avenue NW,and the vacation of 7th Street NW between <br /> 7th&8th Avenues. With Pulte now moving forward with Phase I of the development,the planned vacations <br /> must go through a formal approval process. By code,the City Council(and not the Planning Commission)is <br /> to hold the public hearing on vacations,and make a determination as to whether there is any public interest in <br /> maintaining the right-of-way. Both staff and the planning commission,as part of the preliminary approval <br /> process,recommended approval ofthe vacations for the following reasons: <br /> • The unused cul-de-sac bulb on 7th Avenue NW has not been utilized since its platting in the 1930's, <br /> and construction on adjacent lots over the years have resulted in multiple encroachments that need to <br /> be addressed. <br /> • The ROW for 7th St between 7th&8th Avenues serves a very limited public purpose,and <br /> reconfiguration of roadways in the area as part of Midtown Village(Phase I)works better for both <br /> the developer and adjacent residents. The two single family homes to the north of Midtown Village <br /> between 7th&8th Avenues will each get a new driveway installed courtesy of the developer,and <br /> each lot will increase in size to encompass the new drive. Greenspace will replace the remaining <br /> roadway area providing an improved aesthetic buffer between old and new. <br />
