RESOLUTION NO.2 01 9-1 09 <br /> City of New Brighton <br /> County of Ramsey <br /> State of Minnesota <br /> RESOLUTION MAKING AN ELECTION NOT TO WAIVE THE STATUTORY <br /> TORT LIMITS FOR LIABILITY INSURANCE PURPOSES <br /> Whereas, Minnesota Statutes Chapter 466 deals with tort liability for cities; and <br /> Whereas, Minnesota Statutes 466.04 currently sets the maximum liability limits for cities at <br /> $500,000 per claimant and $1,500,000 per occurrence; and <br /> Whereas, the City procures its insurance from the League of Minnesota Cities Insurance Trust <br /> (LMCIT); and <br /> Whereas, the City's current insurance policies provide coverage up to the tort liability limits as <br /> provided by Minnesota Statutes; and <br /> Whereas,the LMCIT allows the City the option to waive those limits; and <br /> Whereas, the LMCIT has required the City to make an election by resolution with regards to <br /> waiving or not waiving its tort liability established by Minnesota Statutes 466.04; and <br /> Now,Therefore Be It Resolved that: the City of New Brighton does hereby elect NOT to waive <br /> the statutory tort liability limit established by Minnesota Statutes 466.04 <br /> Adopted this 10th day of December 2019, by the New Brighton City Council with a vote of <br /> 5 ayes and 6 nays. <br /> Valerie Johnson, Mayor <br /> Devin assopu t, ing ity Manager <br /> Attest: <br /> Terri Spangrud <br /> City Clerk <br />
