RESOLUTION 2 01 9-1 0 3 <br /> STATE OF MINNESOTA <br /> CITY COUNCIL <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND ESTABLISHING A FIRE LANE FOR <br /> PUBLIC SAFETY PURPOSES OVER A PRIVATE ENTRY INTO THE APARTMENT <br /> COMPLEXES SOUTH OF 6TH STREET SOUTHWEST <br /> WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br /> laws of the State of Minnesota; and, <br /> WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br /> and corresponding zoning regulations to promote orderly development and utilization of land within <br /> the city; and, <br /> WHEREAS, Chapter 9 of the City Code outlines regulations deemed necessary for fire protection <br /> and prevention throughout the City including the creation of fire lanes; and <br /> WHEREAS, fire lanes can be designated by the City Council when it is determined that access to <br /> buildings for public safety purposes can only be maintained by prohibiting vehicle parking on one or <br /> both sides of a public or private road. <br /> NOW,THEREFORE, BE IT RESOLVED,that the City Council of the City of New Brighton <br /> hereby designates the northern private entryway off of 6th Street serving the apartment complexes at <br /> 800, 900, 1000, and 1100 County Road D West; as a fire lane based on the following findings of <br /> fact: <br /> 1. From edge to edge, the private entryway is only 26 feet wide, and parking even on one side <br /> limits the access width to less than the minimum 18 feet required for emergency vehicles. <br /> 2. The private entryway is in significantly poor condition such that damage to public and <br /> private vehicles can occur if potholes cannot be avoided. <br /> 3. Parking in recent years has occurred on both sides of the entryway which has prohibited <br /> emergency vehicles access. <br /> 4. Entryways into a densely populated rental complex must all be kept free of obstructions in <br /> the interest of public safety. <br /> BE IT FURTHER RESOLVED, that establishment of the fire lane is subject to the following <br /> conditions: <br /> 1. In accordance with 9-41(2)(C), it is the responsibility of the owner of record to edge paint, <br /> sign, and maintain the fire lane. Failure of the owner of record to act will result in tfie City <br /> causing the work to be completed with all costs billed to the owner of record. <br /> Page 1 of 2 <br />
