Memorandum of Agreement (Compensates Owner $8,300) <br /> 2. Temporary Access Easement <br /> 3. Temporary Construction Easement <br /> Legislative History: These easements were reviewed and approved by the City Attorney, Metropolitan <br /> Council and LVP, LLC (Owner). <br /> Financial Impact: The City will pay for the easements, appraisal fees, and future lining costs <br /> Explanation: The Metropolitan Council is currently in the final phases of the Long Lake Interceptor <br /> Improvement Project. This project will structurally line regional sewer services on the south side of <br /> Long Lake. Sewer from a large portion of southern New Brighton discharges into the regional pipes via <br /> a sewer pipe under TH 694. During construction it will be necessary for the Met Council to bypass pump <br /> New Brighton sewer around their project. The City will take advantage of this bypass pumping to <br /> structurally line our pipe below 694, which was found to be structurally deficient during recent <br /> televising inspections. In doing so, the City will avoid the costs of bypass pumping and plan <br /> design/bidding services that are being provided by the Met Council. To initiate the City portion of the <br /> project the City worked with Lakeview Apartments for easements. <br /> Prior to the initiation of these easements, the existing right of way or easement area was too confined <br /> to allow a contractor or city to perform the work efficiently. To accommodate the improvements and <br /> to help with the construction process, temporary agreements were created. The City Attorney <br /> prepared the easements, and both the City and property owners will execute them. <br /> Costs and Funding: The City will purchase the temporary easements for $8,300 (the market value <br /> established in an appraisal report by Patchin Messner). These costs will be paid for by Fund 702, Sewer <br /> Improvement Fund. <br /> 4- • <br /> Craig G.
